1. Notify your employer of your injury.

The most important step is to notify your employer.  Don’t wait to tell your employer about a work injury or you could lose out on substantial workers’ compensation benefits.

If you have been hurt at work, there are certain procedures that you must follow.  First, notify the person your employer has designated as the one to whom notice of work injuries should be given.  Notice can be oral, but you should ask to fill out a company accident report or at least give written notice.

If your employer does not have an accident report, you can make one yourself.  Explain when, where and how you were injured.  Describe the extent of your injury.  Give the accident report to your employer and keep a copy for your records.

2. Make a claim for workers compensation benefits.

In North Carolina you must make a claim for workers compensation benefits within two years of your injury.  Written notice should be filed with the North Carolina Industrial Commission.  Also request that your employer notify its workers compensation insurance carrier and ask for a claim number.

When you've been hurt at work and as a result of your injury you can no longer perform your job duties and are out of work you may be entitled to receive what are called temporary total disability benefits.

Whether you qualify for these weekly benefits will depend on the facts of your case and the medical evidence related to the care you have received following the work injury.   The most evident of these is where your authorized treating physician has opined that you cannot work in any capacity and has indicated that in his record.  Where things may get cloudy are when either the doctor has simply restricted your work activities in some capacity and there is an issue of whether either your employer can accommodate them or whether you can perform your job within those doctor mandated restrictions.

Things get complicated fairly quickly in workers’ compensation claim related to return to work issues.
