If you or a family member has suffered injuries as a result of a car accident, the Law Offices of Jeffrey Scott, PLLC can help you. We understand the devastation that can occur as a result of being in a serious auto accident.  We are committed to helping car accident, trucking accident and motorcycle accident victims recover the just and fair compensation they are entitled to receive under the law.

There are a wide variety of vehicles on the many roads in North Carolina at any given time.  There are motorcycles, passenger cars, big rigs, delivery trucks, 15-passenger vans, minivans, SUVs, buses, and others.  Ideally, the drivers of all these vehicles follow all traffic laws and never drive recklessly, negligently or while impaired and the roads these vehicles travel on are always in good repair.  This ideal is, unfortunately, not as common as we’d like.  There are various types of vehicle accidents in North Carolina, including:

Drunk driving accidents;

Dangerous roadway crashes;

Distracted driving accidents;

Cell phone and text messaging accidents;

Speeding accidents;

Rollover accidents;

Overloaded truck crashes;

Hit and run accidents;

Rear-end collisions; and

Failure-to-yield accidents.

The victims of such crashes can be drivers, passengers, bicyclists, pedestrians or anyone else using the roadways and can suffer serious injuries or even be killed in the accident.

Car Crash Injuries

All car accidents have the potential to cause injury and in the worst case, fatalities.  Depending on the circumstances of the crash, a victim may suffer the following injuries:

Brain injury;

Broken bones;

Scrapes;

Bruises;

Lacerations;

Internal bleeding;

Burns; and/or
Spinal cord injury.

A car accident injury can create undue financial, emotional, and physical hardships for the victim, making just compensation a top priority.  An injured victim should not have to worry about being able to pay monthly bills and feed their family while they are trying to recover from a serious injury.

What should I do if I get hurt at work in North Carolina?

Workers’ compensation attorney Jeff Scott provides three simple, yet important steps that will help begin your recovery.

1. Notify your employer of your injury.
The most important step is to notify your employer.  Don’t wait to tell your employer about a work injury or you could lose out on substantial workers’ compensation benefits.
If you have been hurt at work, there are certain procedures that you must follow.  First, notify the person your employer has designated as the one to whom notice of work injuries should be given.  Notice can be oral, but you should ask to fill out a company accident report or at least give written notice.
If your employer does not have an accident report, you can make one yourself.  Explain when, where and how you were injured.  Describe the extent of your injury.  Give the accident report to your employer and keep a copy for your records.

2. Make a claim for workers compensation benefits.
In North Carolina you must make a claim for workers compensation benefits within two years of your injury.  Written notice should be filed with the North Carolina Industrial Commission.  Also request that your employer notify its workers compensation insurance carrier and ask for a claim number.

3. Consider hiring an experienced workers compensation attorney.
A workers compensation attorney can protect you after you were hurt at work.  You will not be charged any fee to meet or discuss your workers compensation case and you really need someone on your side who can advise you about hidden problems before they occur.

Many people jeopardize their workers compensation benefits because they don't understand the law. You might end up having your work comp benefits disputed and still be unable to work.

Figuring out what to do after being hurt at work can seem overwhelming. At the Law Offices of Jeffrey G. Scott, PLLC, we will protect your right to workers’ compensation benefits.

The Basics of Worker Compensation Law in North Carolina.

Hurt At Work in North Carolina? Here Are The Basics of Worker Compensation Law.

When you've been hurt at work and as a result of your injury you can no longer perform your job duties and are out of work you may be entitled to receive what are called temporary total disability benefits.

Whether you qualify for these weekly benefits will depend on the facts of your case and the medical evidence related to the care you have received following the work injury.   The most evident of these is where your authorized treating physician has opined that you cannot work in any capacity and has indicated that in his record.  Where things may get cloudy are when either the doctor has simply restricted your work activities in some capacity and there is an issue of whether either your employer can accommodate them or whether you can perform your job within those doctor mandated restrictions.

Things get complicated fairly quickly in workers’ compensation claim related to return to work issues. The department and self insured employers are motivated to reduce claim costs and one way to reduce costs is to deny weekly disability benefits and necessary, related medical care.  If your medical provider says you cannot work because of your injury or you are incapable of working due to doctor mandated restrictions related to your work injury, but the weekly benefits have nevertheless been denied, we can help.
